AIShot AI Headshot Application - Terms of Service

Welcome to AIShot! These Terms and Conditions ("Terms") govern your use of the AIShot AI headshot application ("App") and any related services provided by AIShot ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Important: Please read these Terms carefully as they affect your legal rights and obligations.

1. Acceptance of Terms

By downloading, installing, accessing, or using the AIShot App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the App on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of this page.

2. Use of the App

2.1 License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.

2.2 User Responsibilities

You agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Ensure that any photos you process using the App comply with applicable laws and regulations
  • Respect the intellectual property rights of others when using the App
  • Not use the App to create, upload, or share content that is illegal, harmful, or offensive
  • Not attempt to reverse engineer, decompile, or disassemble the App

3. AI Processing and Content

AIShot uses artificial intelligence and machine learning algorithms to generate professional headshots. You understand and acknowledge that:

  • AI processing results may vary and are not guaranteed to be perfect
  • The quality of output depends on the quality and condition of the input photo
  • We do not guarantee specific results or outcomes from using the AI features
  • You retain ownership of your original photos and any processed results

4. Privacy and Data

Your privacy is important to us. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your data.

Key points:

  • We process photos locally on your device when possible
  • We do not store your photos on our servers without your explicit consent
  • Any cloud processing is done securely and temporarily
  • You control what content you create and share

5. Intellectual Property

The App, including all content, features, and functionality, is owned by AIShot and is protected by international copyright, trademark, and other intellectual property laws.

What You Own:

  • Your original photos
  • Processed results from your photos
  • Content you create using the App

What We Own:

  • The App and its code
  • Our brand and trademarks
  • AI models and algorithms

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

We do not warrant that the App will be uninterrupted, error-free, or completely secure, or that any defects will be corrected. Your use of the App is at your sole risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, AIShot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or content
  • Loss of profits or revenue
  • Business interruption
  • Personal injury or property damage
  • Any other commercial damages or losses

Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid (if any) to use the App.

8. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice, effective immediately.

Upon termination:

  • Your right to use the App will immediately cease
  • Any data stored on our servers may be deleted
  • Sections that by their nature should survive termination shall survive

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

11. Severability

12. Entire Agreement

These Terms constitute the entire agreement between you and AIShot regarding the use of the App, superseding any prior agreements between you and AIShot relating to the App.

BY USING THE AISHOT APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
